The information as you have reported it is incorrect.

There is nothing in the regulation requiring that overlap of assessment windows be avoided.  
If this consultant is someone you are required to work with, request that s/he provide you with a copy of the regulation that underlies his/her statement.  If that doesn't end the problem, call you state RAI coordinator, who can give you the official word that overlap of assessment windows is appropriate as long as the regulatory timing and scheduling requirements are met.

We have been told by a consultant that having assessments with overlapping dates in the reference period is Medicare fraud.  This person stated that if you use day 8 for you 5 day assessment then you need to move your 14 day assessment out as well so you don't overlap windows. 


Is there any document out there to verify this?
