I am seeing this happen more and more. Medicaid will deny coverage because the skilled services were not capture under Medicare first. I just read an article about this, if I can find it I will let everyone know what magazine it was in. Many state's Medicaid revenue is low and even through it may not have been an issue in the past, it is now.   

It may depend on your state Medicaid requirements.  In some states, if they waive the payment of another source for which they are eligible, they will jeopardize their Medicaid coverage eligibility altogether and could be taken off the program.  It would be a statement they sign in their Medicaid application to the state. Check with your state's Medicaid office and get a copy of the Medicaid application/contract to review.

Many states are seeing themselves as the secondary payor when the patient/resident qualifies for Medicare coverage.
