Is there a new rule somewhere that anyone who is alert & oriented can't be considered to be resisting care?  That would be a real problem, since I've seen many an alert, oriented patient just try to jerk the facility around (or a particular staff member) just to see how far the envelope would stretch before it snapped back on them, or broke, expelling them.
