However, that upper-half driver was accepted at the time it was provided. Then, you can't dictate that some individual (or company) should deal with it because _you_ don't like it. This would even be true even if the whole community now has a different understanding and considers it an OS architecture problem: no one can dictate that someone is responsible for it because it didn't break any existing build or usage.
