Well, the chances of your getting your money back immediately are slim.
 That being said, if you kept paperwork associated with your check, you
can determine if the check was cashed and when.  Given that, you can
complain to your state Atty General and that of the state where the
individual lived or did the particular deed.  If the individual is
criminally charged, you might get some portion of your funds back.

You've discovered one of the weaknesses of a system like Ebay, a
dishonest seller out to scam can develop a good reputation then use that
reputation to get funds from a lot of folks in a hurry.

It might also be that the seller doesn't have the right to deliver what
you bought, but that leaves you in the same position as if the
individual committed fraud.
