There was a whole law review symposium devoted to this topic, organized and
edited by Steven Gottlieb, who provided a comprehensive introductory essay
on the topic, back in 1992. Contributions by such as Amar, Fiss, Levinson,
Michelman, Nagel, Perry, and Sullivan. 55 Albany L. Rev. 535-761.
Unfortunately that issue isn't in the databases of Westlaw, Lexis, or
Hein-online.
