Ehm well I normally run in runlevel three but since I maintain fluxbox I
wanted to know more about runlevel 5 so I installed gdm.

Anyway it seems rather weird since dm can be on by default. It should be
on when you run in 5 and it doesn't matter if you run in 3. Or am I
missing something?

Well it is normally bound to Super_L, not to F13. So it is not a problem
it is totally unexpected. I don't see any good reason why it would be
so. And I consider it a bug.

Yes, they are checked with [ -x $HOME/.xinitrc ]. Beats me why they have
to be executable. startx doesn't require it. But it's bugged elsewhere
as well cause it didn't help.
