Its possible the directory was created by the pre App Store Logic or some other daw or plugin installer with administrator privileges. I think apps distributed via the App Store just install themselves and are self contained and don't write to system directories unless they prompt you for administrative privileges after they are run to install additional items.
Maybe the directory was incorrectly created with the wrong permissions before by an installer. Although I would think running "fix permissions" from disk utility would have reset them to read only for all users. If you really want to write to a system directory you should prompt the user for an administrative password before writing in your app, or do all of your writing to the system directory from the installer pkg.
