It appears You are correct. The Ercoupe Service Memorandum #57, October
11, 
1949 states--- para 2 -:" As a result of recent tests and analysis, it has

been determined that the aileron weights on Ercoupes may be removed and
the 
aileron will still maintain freedom from flutter throughout the
operational 
range of the airplane, provided the aileron free play does not exceed 
5/16"."-----------------, and Para 5, : "Removal of aileron balance
weights 
is not mandaatory, but is recommended for all Ercoupes Model 415C, 415CD, 
415D,E, and G. Thje weight of the parts removed totals 3.5 pounds and
their 
CG is 55.5" behind the Datum line."

Note: 

The Memorandum points out the proceedure for checking free play. 

The Service Memorandum emphatically points out -----"--- Will still
maintain 
freedom from flutter throughout the operational range of the
airplane-------",
implying that the ailerons may in fact create flutter if the operational 
range is exceeded. 

We all know that we are supposed to, and MUST stay below Red Line - Never 
Exceed; and that we must also stay below Manuvering speed in rough air,
etc, 
DON'T WE?

If control flutter does begin to occur, you may be able to stop it by
putting 
a load on the ailerons by banking, and the elevator by a slight climb; and
by 
immediately reducing airspeed.

Short Advice - Don't play test pilot. Fly the airplane - any airplane - 
within the prescribed airspeed and manuvering limits as proscribed in the 
flight manual.
