Heinrich Harke (letters 4th July) does indeed raise
a valid point. Do we still have the choice to avail
ourselves to weapons for self-defence, and more
importantly, can Parliament repeal not only this right
but others too?
The answer would appear to be that Parliament thinks
it can, provided it can rely on its connivance with the
judiciary. A recent Australian High Court case supports
this. McHugh J said "But Parliament - some people would
regard it as regrettable - can, in effect, do what it
likes. As it is said, some authorities could legislate to
have every blue-eyed baby killed if it wanted to."
Not only has no British or Commonwealth government ever
been elected to strip the public of their constitutional
and common law rights, but Acts of Parliament which claim
to do so are constitutionally illegal. I would also argue
that hanging for treason is part of the common law and
cannot be repealed.
No doubt Mr Harke would be in complete agreement.
