You are always free to upload a package, as long as the Legal file documents all known legal issues (and it is in fat legal for you to distribute it). The job of determining if the work meets the DFSGs belongs to the ftpmasters. Debian-legal exists to discuss the issues, which is hoped to assist the ftpmasters in making their decision. My understanding is that the ftpmasters are accepting packages using the GNU GPL v3. They apparently feel that it meets the DFSGs.
