Not the best piece of journalism in the industry. The issues of patents are real, but while it seems possible that MS could have patent rights on the techniques commonly used to implement the ARB_Vertex_program extension, it doesn't mean the end of OpenGL or even that extension. MS have not actually detailed their claim to the best of my knowledge.
