It depends on the individual eula on the software. It's been mentioned in previous posts that Borland are happy to grant people permission for reselling copies of Delphi if there is a genuine reason (downsizing development team etc).
I am fairly sure that you can resell books and cds other wise there would be a lot of second hand book stores and people on trade me breaking the law.
