Could you clarify on this?

I think that those who want to avoid incubation think of the short-term impact on their economic interests and don't think about the long term impact of their decision.

If a community is not functional in incubation, it will be tollerated and worked out.

If a community is not functional as TLP, it will simply be dismantled.

Personally, I think Merlin should be proposed with a radical change from the past that signals a strong change in direction (in terms of community management and spirit of collaboration internal and with other projects), a name change (with no magic or presumption) would go a long way.

Also, I would personally suggest Aaron as the chair, as he's a recognized individual by the board and, AFAIK, his involvment has been seen as productive, fair and balanced, also showing the ability to take action would the need emerge.
