I'm not sure that's true. It was my understanding that the incubator is for new TLP or jakarta sub-projects, but existing TLP projects may add child sub projects in whatever manner they choose.
Maybe I'm wrong though... As far as licensing issues go I think I understand them already for hibernate as I went through that effort a long time ago on the apache legal lists with Henri / others..That is what Daniel's work will buy us...But we also have to find ways to make sure the "message" / verbage of what the projects do also follow what the board would like as far as external libraries go..
