Unfortunately we don't use the color consistent and we don't even have a color in the ColorThemes for this state (we've used highlightColor, backgroundSecondaryColor or custom) so this can't be set yet as standard. Anyway it should be a different color than highlighColor. IMO the selection | highlight standard should apply and be the same no matter of the element. Is should be a very special case if we break the standard. That's why I consider comment header to be an inconsistency.
