Per ICANN, the "gaining" registrar verify that the transfer request is valid. This is what OpenSRS does when transferring a domain to OpenSRS. Some other registrars may not be performing the proper checks and verification, instead they just blindly transfer the name. These registrars should be brought to the attention of ICANN to have their accrediation revoked.
