But the domain registrant still gets penalised for moving to OpenSRS - they
pay NetSol for a years registration, and they pay OpenSRS for a years
registration, but at the end of it, only get 1 year instead of the 2 that
they've paid for, and if they hadn't transferred to OpenSRS the problem
would not have occurred.

Since the registry automatically adds a year, you can pass blame on to NSI.
