Sorta but not quite so optimistic. If the card is present, the customer
needs to provide some sort of credible evidence/testimony of wrongdoing
on your part in order for the chargeback to be successful. Still, "card
present" transactions are much to be preferred.

A thought: If you only want the swiper to prove the presence of the
card, you could do it the old-fashioned way and make an impression of
the card.
