Let me make it clearer then.

ICANN requires that all names that do not specifically opt-out be
included.  Tucows wants this changed to the opposite.  They are
advocating it pretty well, in my opinion, in the registrar
constituency and to the Names Council.

So the default, like it or not, is mandated to be all names in the
list except those that ask to be out.  Any change will require ICANN
Board approval.

Actually, if I remember correctly, the registrars were the ones who
asked for this.

I believe the thinking at the time was to get access to NSI's
database, and to prevent NSI from claiming exclusive ownership of the
data in their whois database.

So ICANN and DoC accommodated them.
