I agree...this is nuts that they can get away with it. I have had personal experience with this in trying to obtain the .com for a .net and .org that I already own...it has been expired for over a year now. I got frustrated enough to call once and was told that they get deleted periodically but there is a (unspecified) grace period to give the previous owners a chance to re-register. When I asked how long the grace period was...he wouldn't tell me.
And ICANN really won't do anything about this? This is nuts...I thought for sure that then the great domain deletion drop happened back a month or two ago, I would finally have my name, but noooooooooo.
