Its a tough one if you have no other relationship with the domain owner
than being their de facto registrar.

We'll terminate anyone spamming using our nameservers. Its in our
Terms of Service and we are very pro-active about it.

If they aren't using your nameservers, or webhosting with you, or using
you for email, what can be done? Does Network Solutions, Register.com
or any other registrar do anything about spam domains or even mention
it in their AUP? For the most part no.

After the nameservice supplier, the registrar is the logical place to go
to clip a spammer's wings though (*cough* *cough* webfinity porn spam
by the boatload who are an opensrs reseller *cough* *cough*)

An unwanted side-effect of the RSP being listed in whois is now you get
the spam complaints.
