Its a tough one if you have no other relationship with the domain owner than being their de facto registrar.
We'll terminate anyone spamming using our nameservers. Its in our Terms of Service and we are very pro-active about it. If they aren't using your nameservers, or webhosting with you, or using you for email, what can be done? Does Network Solutions, Register.com or any other registrar do anything about spam domains or even mention it in their AUP? For the most part no.
