Just make sure you are positive they are culpable, and that your
contract with the customer spells all this out in advance.

Otherwise, you are opening up yourself to the unnecessary risk of a
lawsuit.  As unlikely it may be, all it takes is one with the means to
do it to make your entire year a bad one.
