Richard Tindal is 100 % right. You can sell domain names under every TLD you
want as long as you tell your customers about the limitations of these
domain names. This is also true for keywords.
Examples:
IDN of VeriSign: Inferior Product but legal
New.net: Product with limitations but legal
DotUSA, (TLD Networks): Inferior Product and illegal beacause of no proper
disclosure.

What about your spot checks?
Do you check only new registrations?
Do you check 0.75 % of TOTAL registrations every week?
