It's not a question of if the genie can be put back inthe bottle, it's a 
question of what right do you have to publish the material.

in practice there is a point where the government will find it more 
embarrasing to charge you with publishing the material than it does to see 
the matrial published.

there are times when the right thing to do is to break the law and publish 
even if you will be charged and convicted.

but I don't see how claiming that someone else 'published it first' 
somehow gives you the right to re-publish anything.
