I think it was important to point this situation out. If distributing free software can potentially get you into a legal situation this quickly, then it's just not worth the headache that follows.
IMHO.. The primary reason for searching for an alternative to firefox is not that it sucks but because they are no longer the banner for freedom we once enjoyed getting behind. That's actually what's really been missing here, which goes as far back to the ads in tabs (and DRM/EME) situation. The only thing I can see working, is if developers are happy to remove features and stop rebasing most of their work on firefox and syncing up with their codebase. That and starting a project with a clear goal to protect user freedom and privacy.
