Any chance you could take a capture from a different driver that works and post that to the list? I have tools that can replay capture files and I can verify whether my igb NICs can pass the traffic or not. Also, if the NIC really is throwing away the packet, you won't see it in a wireshark capture. But, if the Linux stack(s) are throwing it away, you would.
