The fact that you are getting this error with the new driver could be a sign that the EEPROM on your system is misconfigured. If you could send us the device ID for the part and a copy of the EEPROM dump for the part via "ethtool -e" we could start work on our end to verify the EEPROM and hardware are functional with the latest driver.
