Actually, it's NOT actually 'illegal'... BUT... you MUST use SSB, and you MUST have every well-suppressed carrier. I don't recall the exact amount of carrier suppression that's required, but it must be essentially negligible, thus, the tone is transmitted AS the CW carrier and the suppressed carrier is low enough that you won't hear it.
