 LAME (Lame Aint an Mp3 Encoder) contains no patented software
and many encoders are based on it. MPEG does not define an
encoding algorithm.

At the bottom of that page there are two links to a description
of what mp3 is. One is from the self appointed patent holders
and the other is more accurate.
 This reminds me of SCO claiming rights over gnu/linux.
I don't see LAME nor gnu/linux being shut down.
