LAME (Lame Aint an Mp3 Encoder) contains no patented software and many encoders are based on it. MPEG does not define an encoding algorithm. http://lame.sourceforge.net/links.php At the bottom of that page there are two links to a description of what mp3 is. One is from the self appointed patent holders and the other is more accurate. This reminds me of SCO claiming rights over gnu/linux. I don't see LAME nor gnu/linux being shut down.
