I have heard that France is one of the few countries actually inspecting products at customs, but the proto/demo marking requirement is out of line. The EMC Directive specifically uses the phrase "placed on the market". A demo unit which is simply making the rounds is certainly not "on the market". According to the head of the BAPT in Germany, they only check products which are sampled from store shelves and will not, even at manufacturers request, inspect at customs. Unfortunately, while a particular inspector in France may be wrong, they could still probably cause you a headache.
