G'day! The problem here is not the Directives themselves (which usually exempt trade fairs and exhibitions), but each countries method of implementing them into their National law.
Here in the UK, the implementing Regulations followed the Directives wording and permitted these exemptions. AFAICR the German and French authorities did NOT include these trade fair exemptions in their implementing laws (feel free to correct me if I'm wrong) - hence the problem. You would really need to study the actual countries implementation to see if they are acting within their (National) law.
