In the USA qualification of avionics to RTCA/DO-160 is required for type certification and it is type certification that must be achieved before using equipment on a/c. I expect that whereas in the US the FAA performs this function, in Europe it is the JAA, and the CE process has nothing to do with it, as type certification antedates the CE mark concept.
