I do not think that applies if the warehouse belongs to the manufacturer
and the products have not been invoiced. In fact, if you think about it,
it cannot possibly apply. A manufacturer, fearing the effects of new
requirements, could make (or claim to have made!) and store 2 years'
sales before the deadline and thus continue to ship non-conforming
product for 2 years after it.
