Hi KC The operating frequency is not one of the restricted bands listed in 15.205, and there is no specific prohibition in 15.231 against operating at this frequency. As long as you meet the applicable requirements in 15.231 and the other relevant Part 15 requirements you may legally market a device of this type in the US.
Operating on a licensed frequency used for radio communications may result in your causing harmful interference as defined in para 15.3(m). If so, under the general conditions of 15.5(a) - (c) you would have to stop operating until the interference problem was fixed.
