Is not a contradiction FCC cover the item that in europe are covered by two standards: classical EMC (EN 301-489-3) and radio parameter that are covered by radio ETSI standard. So during Classical EMC test you exclude the transmit frequency, during the radio test you measure also the transmitt frequency.
