He was prosecuted for failing *safety* tests. The EMC case was recognized as a defect in the *standard* CISPR 14-1, and the UK government could have made an 'Article 8' submission about that defect. It chose not to, probably because the public interest would not have been served by doing so, and CISPR/F undertook to amend the standard (and CISPR 15) to close the loophole. Complying with the applicable standard gives a *presumption* of compliance with the Directive, because the Commission imagines that the standards-writers know their business. There is no duty on manufacturers to 'second guess' the standards. Only if a manufacturer *knows* that a product may produce a potentially interfering emission or suffer from a potentially disabling susceptibility need he take action to rectify the situation.
