Hi All, John - I consider it a nice try - but I don't think that it qualifies. To take advantage of 4.4 of the guide, I believe that the Italian Company would need to request the manufacturer of the equipment to custom make items for that specific location. In my mind, the equipment that falls into this category would be a production line that needs to fit into the available floor space and would be installed. The manufacturer would also need to be able to show that it had taken into account the specific EMC environment that exists at the pre-defined fixed installation.

In particular, because the equipment is portable, it is not easy to see the equipment remaining at the intended site. For this reason, I suggest that the EMC Directive (and any other Directive that is applicable) should be complied with. HOWEVER, if there is a well defined link between the manufacturer and the user - ie. They are the same company with the same name - then using the taking into service may be appropriate hence avoiding the CE marking. In practice, to know that the products are "approved" (by the Company) for safety etc. it my be that some form of marking is required - if nothing else, to satisfy the safety people on the Italian site. In this case, maybe CE marked equipment would be preferable.
