The R&TTE Compliance Association give guidance on such matters, see download section TG11 “Guidance on NB opinion where harmonised standard not applied. http://rtteca.com/html/download_area.htm I quote “Although not mandatory, where a relevant harmonised standard exists, it should generally be applied to the fullest extent possible. Typically, deviations from strict application of the standard would be appropriate where a product design does not permit the application of a particular test in the manner specified but the intention should be establish a similar level of overall technical compliance. Also, it is possible that there is an error in the published standard or that it unintentionally restricts technologies not commercialised at the time of its publication. How rigorously should Notified Bodies (R&TTED & EMCD) require full use of Harmonised Standards? Do they have scope to give positive opinions on the basis of alternative evidence and technical justifications rather than testing to Harmonised Standards even where these harmonised standards exist? How much consistency is there between NB’s, are some more ‘relaxed’ than others? I look forward to your experiences and opinions.
