May I ask where you got the feeling the DoE was abandoning EPS
efficiency requirements? This news item kind of tells the opposite.

Also, it seems that the U.S. Dept of Energy has abandoned charger and EPS
efficiency requirements, so am guessing that most Americano states will adopt
the CEC stuff (California Title 20, sections 160x).
