I think this still depends on which standard applies. At one time, in Europe, 
the mere presence of a PE connection left the product in a grey area between 
Class I and Class II. It's a grey area because the presence made it Class I but 
of course it fails a PE continuity test to accessible conducting parts.

I think that has been resolved, but I'm not sure.
