I agree with Mario Gomez's "rights approach" to address domestic violence....in fact that has been pretty much the base for starting work on drafting a new legislation on domestic violence in India - although this aspect is nowhere reflected in the Bill proposed in parliament by the government. It is crucial that domestic violence is addressed as a violation of constitutional fundamental rights - the right to life and liberty, the right to equality, the right to live with dignity
I also find the idea of using public interest litigation in cases of domestic violence very interesting and exciting. Public interest litigations are filed very frequently in Indian courts, and this may be a novel way of addressing VAW, but it hasn't been tried yet. Its an idea worth exploring.... Jayna Kothari.
