James: The tree is adjacent to a public road. Mr McCarrihan is actually standing on the public road in the picture. I think Mr McCarrihan would enjoy knowing tree lovers are communing with his tree and if you pick up a little road side trash he would even be more appreciative. He lives about 20 miles away in Moundsville, WV.
