I don't think Creative will take these steps. The only thing this is going to do for them is increased sales. People are buying their unit to get a cheap Microdrive and otherwise wouldn't have bought one. And if they try it out first they might decide to buy another one and actually use it what it was intended for. Of course it could be that Hitachi complains (it is a Hitachi drive, right?) but honestly I even doubt that.
