What is the difference between talking about these bands and having them on
your list?

Nothing.

Putting them on your list is a de facto advertisement for trades involving
said bands - just like a post. Whether they have "tradable" or "not
tradable" set is irrelevant; I don't think people have these lists just to
show off.  Etree people, like many others, want to trade these bands, and
while it is admirable that the powers that be have forbidden the discussion
of these bands on the list, I think it is a very glaring error to allow
these bands to appear in the DB.  The reason that various music sharing
programs get shut down is because they facilitate the spread of illegal
music.  The DB also facilitates the spread of illegal music.  Etree
facilitates the spread of illegal music.  The difference between discussing
these bands on the list and allowing them in the DB is one that was created
by people trying to cover their asses.

Furthur has the right idea.

And I don't want to hear legal defenses, because if it ever came to that
point Etree would lose.

And it is -morally- wrong to have those shows...if you like a band you
should abide by their (or the owner of the copyrights) wishes.

I like to beer, but if I get a DUI that is all my fault - there is no wormy
legalism to save me - no matter if I think I am right or not.
