The 2.2.16 kernel -- the base kernel from Linus -- includes
drivers/net/rtl8139.c.  Did you configure the driver into your kernel?
You shouldn't have to add it from an external source.

PS: Jogger-egg.com is running an rtl8139.  Works good for me.
