It will still be legal to sell HDTV card but they will have to
support the broadcast flag. There probably won't be an open
source way to do that though. I just purchased the ATI HDTV
Wonder from Best Buy and during install there is statement in
the license agreement saying that their is proprietary
information in there that forces them to keep it closed source. 

Why the ATI you might ask? Price and what you get. Yes, I know
it's a Windows only solution right now BUT... for $149 you get
the card, antenna, AND the RF remote which DOES work under
linux. I plan to use the remote on a different PC. As for HD, I
picked up all the local during my scan but not everyone was
broadcasting HD content at 11pm last night. There's still DTV
though. Looks pretty good I must say. 

Lastly, for a video card and linux, get at least a Geforce card
for best playback. Riva and TNT cores will hardly cut it. I
still plan to do a MYTHTV box too at some point but it will be
more for a media library front. I was even thinking of Myth on
my mini.
