this has several implications that are not all that clear and is
likely to have some unforeseen interactions with national laws like
the DMCA.
Does this mean that if you have a method for cryptographically
authenticating system software at boot that you have to include the
private key that allows you to sign your kernel binaries...?

This will cause some screaming. and gnashing of teeth, don't expect
this one to make it into the final product, although if you are a
smaller player dependent on FOSS tools (as most of us are) it's a good
idea that could serve as a safe haven from the patent wars.
