You have hit the nail on the head - it is down to interpretation. Some could say that because the email comes from my business domain and has my business name on the signature that it is a business letter, possibly because I have not said otherwise.
While it is fine for me to decide what is and is not a business letter - do you want to other staff members to make that decision? I doubt it, so the play it safe route is to treat all emails that are coming out of the site as business letters and attach a disclaimer with the relevant information to everything. I personally dislike disclaimers, but it would appear that they are now being forced on to all business due to this legislation change.
