The ADC is hard coded to create a Universal Distribution Group, so this is normal. The reason you need a native mode domain is so that when the store.exe process tries to upgrade the distribution group to a security group, the process will actually succeed (since USGs can only exist in a native mode domain). The impact to you in your scenario is that public folder permissions may fail.
